WASHINGTON — The Justice Department is fighting to put Fake News accountability back on the books. In a filing reported October 3, 2026, DOJ asked U.S. District Judge Timothy Kelly to deny CNN, MS NOW, and Politico a longer preliminary injunction and to restore the White House’s ability to reinstate President Donald J. Trump’s access ban once the temporary restraining order expires around October 8.
The America First legal frame is simple and public: “Access to the White House is a privilege—not a right.” DOJ argues the White House is the home and workplace of the Nation’s Commander-in-Chief, and that privileged access can be conditioned on basic minimum standards of professionalism and decorum — including not publishing sensitive or classified information.
The dispute began September 18, when Trump announced the ban on Truth Social, accusing the three outlets of constantly writing or reporting “FICTION and LIES” while covering the President of the United States. Judge Kelly later issued a TRO restoring hard passes for roughly 14 days. The outlets want a preliminary injunction to lock that access in while the case continues; DOJ says they are unlikely to succeed and have not shown irreparable harm that outweighs the government’s interest.
Per the filing as reported by the Washington Examiner, the administration says the outlets failed to meet those professionalism standards and did not submit a timely response to the White House’s allegations before the original deadline. DOJ also argues portions of older D.C. Circuit forum doctrine (Sherrill) were wrongly decided — a straight institutional fight over who sets the rules inside the White House complex.
Patriots already know the contrast. Privileged access to the most powerful workplace on earth is not a participation trophy for outlets that traffic in fiction. Watch the Official White House Oct. 2 video “Fake News CNN” while the Oct. 8 hearing approaches. Accountability is not retaliation — it is the Golden Age standard for anyone who wants a hard pass to cover this President.
